Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN THE SWEEPSTAKE (“SWEEPSTAKE”) Entry into this Sweepstake constitutes your acceptance of these Official Rules. Internet participants: Sweepstakes are intended for viewing and participation by all individuals from all areas except where prohibited (see below). Do not proceed with this Sweepstake if you are outside of the eligible areas. 

SWEEPSTAKE ENTRY DATES: Sweepstake will begin on September 23rd, 2024, at 8:00 A.M. PDT and will end on September 27th, 2024, at 8:00 A.M. PDT (“Sweepstake Entry Period”).  Sponsor is the official timekeeper for this Sweepstake. 

WHO MAY ENTER: Sweepstake is only open to all legal residents of the United States over the age of eighteen years old. Rhode Island residents are not eligible to enter. Void anywhere where prohibited. When entering the Sweepstake, an opportunity to sign up to receive follow-up information from Sunrider may be available. Entrants agree and are subject to all notices posted online, including but not limited to Privacy Policy and Terms of Use. Employees and their immediate families (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) or those living in the same household (whether or not related) of Sunrider (“Sponsor”), and its respective parents, affiliates, subsidiaries, prize suppliers, and advertising and promotion agencies (collectively, “Sweepstake Parties”) are not eligible to enter or win. Sweepstake entrant may need to provide proof of residency upon request. Void where prohibited by law. Subject to all applicable federal, state, and local laws and regulations. 

SWEEPSTAKE ENTRY: In order to enter, during the Sweepstake period, each entrant must follow Sunrider’s Instagram page (@sunriderusa on Instagram).  Entrants must “like” Sunrider’s announcement post and tag a friend who will “fall” in love with these flavors. Bonus five (5) entries for sharing in your story and tagging @SunriderUSA. All submissions must be made during the Sweepstake Entry Period, and the entrant’s account must be set to “public” when submission is made. 

One (1) winner will randomly be selected to win a Sunrider® Fall Flavor Giveaway Prize Package.  A winner will receive a prize package, which contains one (1) SunFit® Protein Plus Pumpkin Spice, one (1) ERB Whole Food Turmeric, one (1) Calli® tea Cinnamon [10 bags pack], all package items shall be selected by Sponsor.  An existing Sunrider customer or IBO account is not required to participate in the giveaway event.  Product credit, if any, shall be applied to the winner’s customer or IBO account.  No monetary exchange for the product credit.   

The winner and their entry(s) may also be featured in a special email announcement and on Sunrider’s social media channels.  

Sponsor reserves the right to disqualify any Entry for any reason, in its sole and absolute discretion.

The odds of winning depend upon the number of entries received. Sponsor reserves the right to substitute prizes of equal or greater value at Sponsor’s sole discretion, or to end the Sweepstake due to lack of participation. The winner agrees to pay shipping and all other costs for and in connection with any prize(s) granted by Sunrider during the Sweepstake. All taxes are the responsibility of the winner. All prizes are for personal use only, non-transferable, with no cash redemptions and/or substitutions except at Sponsor’s sole discretion. If the winner prefers a specific quicker shipping method, they are responsible for notifying us immediately and will also be responsible for covering the additional costs if any. Additionally, pursuant to applicable U.S. law, cash prizes will not be made to select persons who are prohibited from receiving such payments. 

WINNER SELECTION: One (1) winner will be randomly selected from all entries during the Sweepstake Entry Period.  

WINNER NOTIFICATION:  A winner will be determined at the end of the Sweepstakes and notified by email and/or social media on September 27th, 2024. The winner will be required to provide a mailing address which will be used to fulfill the prize. At the discretion of the Sponsor, the winner may be disqualified for any of the following reasons: if charged with or convicted of a felony or misdemeanor, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government-ordered payment, such as, but not limited to: child support, spousal support, alimony, tax payments, violation of rules established in the Sunrider Business Guide, etc. In the event it is determined that the winner has not complied with these Official Rules, has failed to execute and return any required documents within the specified time period, has made false statements, or a prize notification is returned as undeliverable, then the winner will be disqualified and at Sponsor’s sole discretion. 

PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): ARV for each prize package is approximately USD $101.66. The winner is not a prize recipient until s/he has been verified as a winner by the Sponsor or judges.  POTENTIAL SWEEPSTAKE WINNER(S) IS SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING (WITHOUT RIGHT OF APPEAL) IN ALL MATTERS RELATED TO THE SWEEPSTAKE, PROVIDED THE DECISION IS REASONABLE. Upon fulfilling the prize, Sponsor will be deemed to have awarded the prize to the winner, and such winner assumes full responsibility for the prize. All prize details are at Sponsor’s sole discretion. 

At its discretion, the Sponsor reserves the right to reschedule the Sweepstake, entry, and/or end dates, modify the entry procedures, or cancel the Sweepstake. Prize(s) are not redeemable for cash.  The price is non-transferable and non-assignable, and no substitutions will be made, except as provided herein at the Sponsor’s sole discretion.  The Sponsor reserves the right to substitute the prize or a component thereof for any reason with a prize or a prize component of equal or greater value.  The Sponsor reserves the right to place reasonable restrictions on the availability or use of the prize or any component thereof for any reason.  The winner is responsible for all taxes and fees in any jurisdiction associated with the prize receipt and/or use.  No difference between the actual and ARV will be awarded. 

GENERAL CONDITIONS: By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Sweepstake judges, which are binding and final (without right of appeal) in all matters relating to this Sweepstake; (b) release and hold harmless the Sponsor and each of its respective parents, subsidiary and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstake and all of their respective past and present officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses and liability, including (except where prohibited) but not limited to, negligence and damages of any kind to persons and property, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right and publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstake, acceptance of use or misuse of prize and/or the broadcast, exploitation or use of entry, and (c) indemnify, defend ad hold harmless the released Parties from and against any and all claims, expenses and liabilities 9including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstake and/or entrant’s acceptance, use, or misuse of prize; and (d) each entrant grants permission (except where prohibited by law) to use their name, winning post, images, hometown, likeness, prize won, voice, opinions, and photograph (all at Sponsor’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission.  Where prohibited, the Sponsor will request winner’s permission to use winner’s name, likeness and/or photograph for promotional purposes. 

Released Parties are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete, or delayed Entries; all of which will be void. Released Parties are also not responsible for problems related to technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled, or misdirected communications which may limit a Sweepstake entrant’s ability to participate in this Sweepstake. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Sweepstake, including, without limitation, errors or malfunctions with may occur in connection with the administration of the Sweepstake, the processing or judging of Entries, the announcement of the prize, or in any Sweepstake-related materials. Mass entries generated by a script, macro, or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend, or terminate the Sweepstake in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Sweepstake in its entirety should tampering, unauthorized intervention, fraud, technical failures, or other causes corrupt the administration, security, fairness, integrity, or proper play of the Sweepstake and, if terminated, at Sponsor’s discretion, determine the winner using all non-suspect, eligible entries received up to time of cancellation using the judging procedure outlined above. In the event of a dispute regarding entries received from multiple users with the same email account, the authorized subscriber of the email account at the time of Entry will be deemed the Sweepstake entrant and must comply with these Official Rules. An authorized subscriber is the natural person assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses. Sponsor reserves the right at its sole discretion to disqualify any individual (and void his/her Entries) it finds to be tampering with the Entry process or the operation of this Sweepstake or website, intending to annoy, abuse, threaten, or harass any other Sweepstake entrant, Sponsor, or any of its representatives or to be otherwise acting in violation of these Official Rules. CAUTION: Any attempt by a Sweepstake entrant to deliberately damage any website or undermine the legitimate operations of the Sweepstake is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such Sweepstake entrant to the fullest extent permitted by the law and to disqualify such Sweepstake entrant from the Sweepstake. 

ASSIGNMENT OF RIGHTS: Entrant hereby acknowledges that Entry and all other materials of every kind whatsoever created by Sweepstake entrant relating to the Sweepstake (collectively, the “Work”) are a “work made for hire” (as that term is used in the United States Copyright Act) for Sponsor, and assigns to Sponsor (or, if any applicable law prohibits or restricts such assignment, Sweepstake entrant hereby grants to Sponsor an irrevocable, perpetual, royalty-free, transferable license of) limited right, title, and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised. By submitting an Entry, Sweepstake entrant acknowledges and agrees that Sponsor may obtain many submissions under this Sweepstake and that such entries may be similar or identical in theme, idea, format, or other respects to others submitted under this Sweepstake and/or other Sweepstakes staged and/or sponsored by the Sponsor, and waive any and all claims Sweepstake entrant may have had, may have, and/or may have in the future, that any composition, design, video ,and/or other works accepted, reviewed and/or used by the Sponsor (or its respective designees) may be similar to his/her Entry. Sweepstake entrant acknowledges and agrees that the Sponsor does not have now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to Sweepstake entrant’s Entry. 

MISCELLANEOUS CONDITIONS: To the extent permitted by law, the Sponsor reserves the right, in its sole and absolute discretion and in consideration of the Entrants’ interests, to cancel, suspend and/or modify the Sweepstake, or any part of it (including, without limitation, these Official Rules), if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstake, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstake, to be acting in violation of these Official Rules or any other promotion, or to be acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstake may be a violation of criminal and civil law and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Promotion, or to amend these Official Rules, without prior notice or obligation, in the event of any accident, printing, administrative or other error of any kind, or for any other reason. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Official Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Promotion as contemplated in these Official Rules. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Sweepstake-related materials, the terms and conditions of these Official Rules shall prevail, govern and control. Failure to comply with these Official Rules may result in disqualification from the Sweepstake. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. Sweepstake subject to all federal, state, and local laws and regulations. Void where prohibited by law.

ARBITRATION & CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this Sweepstake, Sweepstake entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstake, or any prizes awarded, shall be resolved individually, without resort to any form of class action lawsuit, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Sweepstake entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Sweepstake entrant be permitted to obtain awards for, and Sweepstake entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than Sweepstake entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstake), and Sweepstake entrant (or, if an eligible minor, his/her parent or legal guardian) further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Sweepstake entrants and Sponsor in connection with this Sweepstake, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA without regard to its choice of law rules.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

WINNER LIST:  The winner of the Sweepstake will be announced on September 27th, 2024, and the prize will be sent out within two weeks of the winner accepting the prize.
